INDIRA GANDHI LOSES SUIT AGAINST IGP, GOVT

KUALA LUMPUR 28 JUNE : Today, the High Court dismissed M. Indira Gandhi, a kindergarten teacher, from her RM100 million lawsuit against the government, the Royal Malaysia Police (PDRM), and the Inspector-General of Police (IGP) for allegedly neglecting to apprehend her ex-husband and bring back her kidnapped daughter.
Before going to the Syariah Court to get custody of the children, Muhammad Riduan Abdullah, the ex-husband of Indira Gandhi, unilaterally converted his three children to Islam in 2009 without getting her permission. However, the Federal Court declared in 2018 that the three children’s unilateral conversion to Islam was void as stated in Bernama.com
Judicial Commissioner (JC) Datuk Raja Ahmad Mohzanuddin Shah Raja Mohzan declared that the efforts of the PDRM and then-IGP Tan Sri Abdul Hamid Bador were not suggestive of any dereliction of duty, based on the facts shown to him.
Having all that evidence before me and coupled with the fact that for the plaintiff to succeed in the tort of nonfeasance, the plaintiff still must demonstrate the existence of malice or bad faith. It is impossible for me to conclude that the IGP and PDRM did not attempt to locate the whereabouts of her ex-husband Muhammad Riduan Abdullah.
“I conclude that the IGP and PDRM exercised their duties in the manner they considered to be most appropriate. How they conducted their investigation is within their wide discretion, and I am in no position to second-guess them.
“Essentially, what matters to me is that there is evidence that an investigation has been conducted and is still in progress,” announced the JC ( source Astro Awani )
