Security Guard Charged with Rape and Sexual Assault of 12-Year-Old Sister-in-Law

4 SEPTEMBER: A 29-year-old security guard was charged in the Sessions Court here today with two counts of rape and physical sexual assault against his 12-year-old sister-in-law, alleged to have occurred in January and February of this year.
The accused pleaded not guilty to the charges read before Judge Zulkifli Abdullah.
According to the first charge, the accused is alleged to have raped the 12-year-old girl, who was six months away from her 13th birthday at the time of the incident. The act took place at an unnumbered house in Tok Bok, near Machang, at 7:40 PM on January 30, 2024. The relationship between the accused and the victim is legally and religiously prohibited, making marriage between them unlawful.
This charge is framed under Section 376(3) of the Penal Code, which carries a mandatory prison sentence of at least eight years and up to 30 years, along with no less than 10 strokes of the cane.
The second charge accuses the man of committing physical sexual assault on the same victim in a Perodua Alza car while traveling at 7:00 AM on February 4, 2024. This offense falls under Section 14(a) of the Sexual Offences Against Children Act 2017 (Act 792), punishable under Section 14 of the same act. If convicted, the accused could face a prison term of up to 20 years and possible caning.
Deputy Public Prosecutor Ahmad Faiz Fitri Mohamad did not propose bail, citing the gravity of the offense. However, the defense counsel, Muhammad Zulfaqar Al-Basysyar, requested minimal bail, considering the financial difficulties of the accused’s family.
The court granted bail at RM15,000 with one surety and imposed additional conditions that the accused must not contact the victim or prosecution witnesses. The case is scheduled for mention on October as stated in TV3 BULETIN.
